The court said that it does not see any merit in the petition of Facebook and WhatsApp on the basis of which the CCI’s direction of investigation should be interfered with. The CCI, while presenting its stand before the Single Bench, said that it is not investigating the alleged breach of privacy of the individual which is being dealt with by the Supreme Court. The CCI argued before the court that WhatsApp’s new policy is heavy. A large amount of user information will be collected and they will be secretly monitored for targeted advertising with the aim of engaging more users and thus an alleged abuse of dominant position. The regulator said, “There is no error on the question of jurisdiction. The CCI also opposed the petitions of WhatsApp and Facebook, in which they had termed the decision incompetent and wrong.
