Privacy Row: Delhi High Court on Facebook and WhatsApp’s appeal to CC…


Facebook and WhatsApp challenged the March 24 order of the CCI, which directed an investigation into the new privacy policy.

New Delhi. The Delhi High Court on Thursday sought a response from the Competition Commission of India (CCI) on the appeals of social media platforms Facebook and WhatsApp, in which the new privacy policy of the messaging app has been investigated. The order of the Single Bench dismissing their petitions against giving the order has been challenged.

A bench of Chief Justice DN Patel and Justice Jasmeet Singh issued notice to the CCI, which ordered the inquiry, and sought its response till the next hearing on May 21. The Single Bench, in its order on April 22, had said that though it would be prudent for the CCI to wait for the decisions on the petitions filed in the Supreme Court and the Delhi High Court against the new privacy policy of WhatsApp, but failing to do so, the order of the regulator was erroneous or Will not reduce jurisdiction.

The court said that it does not see any merit in the petition of Facebook and WhatsApp on the basis of which the CCI’s direction of investigation should be interfered with. The CCI, while presenting its stand before the Single Bench, said that it is not investigating the alleged breach of privacy of the individual which is being dealt with by the Supreme Court. The CCI argued before the court that WhatsApp’s new policy is heavy. A large amount of user information will be collected and they will be secretly monitored for targeted advertising with the aim of engaging more users and thus an alleged abuse of dominant position. The regulator said, “There is no error on the question of jurisdiction. The CCI also opposed the petitions of WhatsApp and Facebook, in which they had termed the decision incompetent and wrong.

It is noteworthy that WhatsApp and Facebook had challenged the March 24 order of the CCI, in which it was directed to examine the new privacy policy.
