WhatsApp Privacy Policy: CCI said, only because of the competition aspect…

New Delhi. The Delhi High Court on Tuesday said that the Competition Commission of India’s (CCI) investigation into the new privacy policy of WhatsApp is probably more related to concerns about the privacy of consumers. The court said that this does not appear to be an investigation of abuse of market dominance. The CCI told the court that it was not investigating the breach of privacy of individual individuals. This matter is in the Supreme Court. To this, Justice Navin Chawla said, “It seems that the regulator is concerned about the issue of privacy of the consumers.”

“Your order does not reflect the investigation into the situation of alleged market dominance,” the court said. In this case in the Delhi High Court, on Tuesday, Competition Commission’s counsel Aman Lekhi said that the new privacy policy of WhatsApp will lead to excessive collection of data (personal information) of users of this network-platform and it will help more and more users. Would be like ‘chasing’ consumers to do targeted advertising for the purpose of connecting. This is a way to abuse your dominant position in the market.

The CCI has ordered an inquiry into the new privacy policy of messaging platform WhatsApp. Justifying its investigation, the CCI presented its stand before the court. Lekhi said the CCI is looking into the competition aspects in the matter. The competition regulator is not looking into the matter of violation of personal privacy. The matter related to the right to privacy is in the Supreme Court.

CCI’s counsel submitted that there is no question of error of jurisdiction in this matter. He said that the petitions filed by WhatsApp and Facebook challenging the CCI’s decision are based on ‘unfair and false assumption’. Senior advocates Harish Salve and Mukul Rohatgi are representing WhatsApp and Facebook in this matter. These companies have challenged the CCI’s March 24 order to investigate the new privacy policy. The High Court has reserved its order in this matter. Lekhi told the court that whether the collection of data by WhatsApp and its sharing with Facebook is anti-competitive or not, it will be decided only after investigation.
